Yaz Lawsuit Motion Denied

07/11/2012 A motion made by the a group of lawyers in the Yaz Lawsuit Multidistrict Litigation, often referred to as the Yaz Class Action Lawsuit, was denied by the presiding Judge David R. Herndon.

The motion before the court was brought on behalf of plaintiffs seeking to force Bayer, the primary defendant in the Yaz Lawsuit, to release 330 documents that had previously been withheld by Bayer. Bayer had asserted that the documents in question were protected by attorney client privilege. The court agreed with Bayer on almost all counts and handed down a ruling that was in favor of Bayer denying the majority of the Yaz Lawyers representing the plaintiff’s motion.

The ruling in Favor of Bayer is generally not seen as a major setback for Plaintiffs in the Yaz or Yasmin Lawsuit as Bayer has already announced that it intends to settle the vast majority of the Yaz and Yasmin Lawsuit cases it currently faces. Bayer has already turned over more that 3.5 Million documents to Yaz Lawsuit Plaintiff Attorneys during the discovery process of the Yaz and Yasmin Multi District Litigation. A dispute over the production of documents during the discovery phase of lawsuits is common. It is not unusual for the disputed documents to have little probative value to either party however, the party seeking the documents cannot know if the documents will be helpful to their case unless they seek and receive the documents.

Numerous other motions are before the court pertaining to the Yaz and Yasmin Lawsuit. We will continue to report on the outcome of these motions as the information becomes available to us.
